Military Must Accept Transgender Troops From 2018, Federal Judge Rules

While Kollar-Kotelly's initial October ruling did not halt Trump's ban on enlisting transgender individuals, her latest injunction does.

The ruling on Monday by U.S. District Judge Colleen Kollar-Kotelly clarified an earlier order from October which partially blocked President Donald Trump's memorandum that disallowed transgender individuals from serving in the U.S. military. Last week, U.S. District Judge Marvin Garbis issued a second order against Trump's policy as a result of a separate lawsuit filed by the American Civil Liberties Union.

At the time, the block was only understood to prevent the dismissal of currently-serving transgender troops, on the basis that the six active-duty troops now suing the administration to have the ban declared unconstitutional were likely to win.

In June of 2016, the Department of Defense told transgender members of the armed forces it was safe to come out and serve openly and authentically, and estimates show there are thousands of transgender individuals now serving in the military.

Now, Kollar-Kotelly's clarification removes the last aspect of the Guidance Policy For Open Transgender Service Phase Out, issued by Trump's Defense Department on August 25, that was still in effect. The Trump administration had asked whether her ruling prohibited Defense Secretary James Mattis from extending the delay on new enlistments, arguing that she could not have intended such a prohibition because she had not challenged Mattis's authority to do so.

In the ruling Monday, Kollar-Kotelly clarified Mattis can't delay the date further and the military must continue to follow the Obama administration's transgender recruiting policies by January 1, 2018.

Trump has still not said if he believes Moore's accusers are lying and he has not formally endorsed the former judge's campaign. Nine women have accused Moore of sexual misconduct, including one who was just 14 when Moore, then in his 30s, approached her.

"A$3 ny action by any of the defendants that changes this status quo is preliminarily enjoined", Kollar-Kotelly wrote.

GLAD and The National Center for Lesbian Rights represent the five longtime transgender military service members who sued the government in August, claiming that Trump's efforts to ban transgender people from military service was unconstitutional and denied them equal rights and due process. And while all of the injunctions issued thus far are only in place pending the resolution of particular lawsuits, it seems likely that these cases will have to proceed all the way to the Supreme Court for the Trump administration to have a chance of prevailing. The ruling means transgender people can enlist in the military beginning on New Year's Day.

Trump's ban didn't make it three months before meeting rebuke in Kollar-Kotelly's D.C. court ruling.

Garbis' order will not only temporarily allows transgender troops to openly enlist in the military, but also allows current service members to receive any scheduled transition-related medical care, according to court documents obtained by NPR.

In a series of July tweets, Trump announced that the military would not "accept or allow" the presence of "t$3 ransgender individuals to serve in any capacity in the US military".
