
Rowlette's parents went to Dr. Mortimer in 1979 at the Obstetrics and Gynecology Associates of Idaho Falls, where her mother was diagnosed with a "tipped" uterus and her father with low sperm count and motility.
The lawsuit states that she received a notification from Ancestry.com last July informing her she had a DNA match. "Dr. Mortimer knew Kelli Rowlette was his biological daughter but did not disclose this to Ms. Ashby or Mr. Fowler", the 14-page complaint noted.
"Dr. Mortimer knew that Kelli Rowlette was his biological daughter, but he did not say that to either Ashby or Fowler", according to the papers.
The lawsuit, against Dr Mortimer and Obstetrics and Gynecology Associates of Idaho Falls, accuses them of medical negligence, fraud, battery, negligent infliction of emotional distress and breach of contract.
Yet past year, Rowlette, now 36, discovered through a commercial DNA test that she had a parent-child genetic match with her mother's doctor, Dr. Gerald Mortimer, according to the lawsuit. According to the lawsuit, Rowlette's parents were "devastated" by the results of the Ancestry.com DNA test and struggled with how to tell Rowlette that the results of the DNA were correct. They even remembered that when they informed the doctor, who brought the girl to the world and cared after it was born, how they would move to Washington, he cried.
Kelli Rowlette and her parents are represented by Shea Meehan of Walker, Hey, Meehan and Eisinger in the fertility fraud case, reports Courthouse News. Ms Rowlette's parents were aware of this, and requested a donor who was a college student, over six-foot tall, with brown hair and blue eyes.
Dr Mortimer recommended artificial insemination, or using a mix of semen from Mr Fowler and an anonymous donor, chosen by the couple based on whatever characteristics they desired.

Court documents show Rowlette learned who Mortimer was after her parents told her about the procedure and Mortimer's role as her mother's obstetrician.
It is not clear if Dr Mortimer has an attorney.
So far, Mortimer has not commented on the allegations against him, according to the Idaho Statesman.
In August 1980, Ashby found out she was pregnant and gave birth to Rowlette on May 20, 1981.
We knew that Dr. Mortimer worked in Idaho Falls in southeast Idaho as an OB/GYN.
She initially believed the results were flawed and was "disappointed" with them, according to the complaint.
"However with this, people may learn of unexpected connections. Anyone who takes a test can change their DNA matching settings at any time, meaning that if they opt out, their profile and relationship will not be visible to other customers".
